Bad News from Bad Wax

I'll have to look into this a little more, but this was posted on Bad Wax this morning.

Is it the end of the monthly contest around here?

I don't know. I certainly hope not.

  1. First off, I think one would get a warning before any legal action was taken, a cease and desist type of thing. Plus, I just think the contests we do would probably slip through the cracks, be considered a type of fair use, since our prizes are usually "used" cards or highly specialized gifts (packs) and not equivalents of cash values: i.e. gift cards and such. Finally, we could still call it a contest even if it's a sweepstakes, and say that all entrants' merits were equally winning, and thus still randomize.

    Lastly, can't let The Man keep us down!

    I'm planning on doing my first contest soon, and I'm not too worried about this, but it's always good to know. That's half the battle!

  2. Thanks for the link. From what I understand this is not on the front burner of the FTC. Thats not to say that it won't be at some point. As contests get more popular in the blog world and as more and more cards of value are being given away, you are going to see some changes.

  3. First off.....screw the FTC. They have more important things in this world that need focused on rather than some guy's "giveaway". If I want to give something away I will and I don't care what it is that I give away.

    Secondly......get rid of the lawyers that even attempt to silence the masses!

    Thirdly......give nothing but TOPPS cards because they don't hold much value anyhow.
